Surgical Error

A lack of informed consent is “the failure of the person providing the professional treatment or diagnosis to disclose to the patient such alternatives thereto and the reasonable foreseeable risks and benefits involved as a reasonable, medical, dental or podiatric practitioner under similar circumstances would have disclosed, in a manner permitting the patient to make a knowledgeable evaluation.” If a patient is deprived the opportunity to make an informed decision about the surgery or treatment proposed, they may be entitled to recover financial damages if the surgery or treatment proceeds and causes a violation of the patient’s rights, or illness, injury or wrongful death.
